Electronic Signature Disclosure

The Electronic Signature Disclosure and Consent ("E-Sign Disclosure") contains important information that you are entitled to receive before you consent to transact business with FAIRWINDS Credit Union (collectively, "FAIRWINDS," "we," "us," and "our") electronically. The words "I," "you," and "your" mean the applicant or member account owner. Please read this notice carefully. You can print or download a copy for your records at www.fairwinds.org.

This E-Sign Disclosure applies to any and all accounts, products, and services that you are applying for online ("Account"). You consent to receive your Account Agreement(s) ("Agreement") containing the initial disclosures in an electronic format and that the Agreement will be considered "in writing" as FAIRWINDS is required by law to provide. You further consent to receive other initial disclosures ("Disclosures") in electronic format, including our Truth-in-Savings disclosure and Privacy Policy. FAIRWINDS is required to provide you with these disclosures prior to you using your Account. By applying for this Account online, you also consent to receive electronic billing statements, periodic account statements, and other notifications ("Electronic Records") for your Account in an electronic format. Collectively, the Agreement, Disclosures, and Electronic Records will be called "Electronic Communications". You should download or print a copy of all Electronic Communications provided to you, including the Agreement and Disclosures, for your records.

We may post any or all Electronic Communications on FAIRWINDS Online, which is accessible from our website, www.fairwinds.org. If we post Electronic Communications on FAIRWINDS Online, we may send a notice via e-mail or through FAIRWINDS Online alerting you of the posting of such records. You agree that you will log in to FAIRWINDS Online periodically to ensure you receive such notices. If we post Electronic Communications on FAIRWINDS Online, the Electronic Communications will remain available for at least twenty-four (24) months. We reserve the right to send any or all records to you in paper form to your current postal mailing address in our records.

You should download or print a paper copy of any Electronic Communication that is important to you and retain a copy for your records.

Hardware and Software Requirements

In order to download, access, view, read, print, and retain the Agreement, Disclosures, and Electronic Records, you must have access to:

  • A device capable of connecting to the internet, such as a computer.

  • An internet browser that supports 128-bit encryption, such as the latest versions of Internet Explorer, Chrome, or Safari.

  • A valid e-mail address and e-mail software capable of reading and responding to your email.

  • Sufficient electronic storage capacity on your device or on another data storage unit to retain the Electronic Communications.

  • A printer that is capable of printing from your browser and email software if you choose to create a paper version of the Electronic Communications.

  • Adobe Acrobat Reader – A free copy of Adobe Reader may be obtained from the Adobe website at www.adobe.com or downloaded from our online banking site.

E-mail Communication

We may notify you by e-mail about Electronic Communications available to you. You are responsible for providing us with a valid e-mail address to accept delivery of Electronic Communications. You are responsible for notifying us when your e-mail address changes. You acknowledge and agree that the Internet is inherently insecure. Therefore, you agree that we have no liability to you whatsoever for any loss, claim, or damages arising or in any way related to our response(s) to any e-mail or other electronic communication which we, in good faith, believe you have submitted to us. We have no duty to investigate the validity of or verify any e-mail or other electronic communication. We may respond to an e-mail communication provided by you to either the address provided with the communication or the e-mail address provided by you through FAIRWINDS Online. To change your e-mail address through FAIRWINDS Online, log into Online Banking, go to My Settings, and update your e-mail address.

Any e-mail returned to us as undeliverable or undelivered may be resent to you at any other e-mail address that we have in your file unless you have previously informed us through an electronic or written notice that an e-mail address is no longer valid.

Although we have no obligation to do so, we reserve the right to require authentication of e-mails or Electronic Communications. The decision to require authentication is at our sole discretion. We will have no obligation, liability, or responsibility to you or any other person or company if we do not act upon or follow any instruction to us if a communication cannot be authenticated to our satisfaction.

You have the right to terminate your receipt of Electronic Communications and receive paper records at any time by logging into your FAIRWINDS Online Account, clicking on "Change Delivery Preference" under the E-Statements option of the Additional Services tab and choosing "Yes, I want to receive paper statements." Your records will be mailed to you in the future thereafter to the address in our records. FAIRWINDS Credit Union has the right to terminate its obligation to provide Electronic Records to you ten days prior to written notice by e-mail or US Mail. You also have the right to request a paper copy of the Agreement, Disclosures, and all other Electronic Communications if applicable law specifically requires us to provide such documentation. A fee to receive paper copies of these Electronic Records may be assessed as set forth in our Service Charge Schedule.

By submitting your application, you hereby give FAIRWINDS your affirmative consent to provide the Agreement, Disclosures, and Electronic Records to you as described in the E-Sign Disclosure regarding the Account and that your device satisfies the hardware and software requirements specified in the E-Sign Disclosure.
